Membership Liability Waiver
IMPORTANT: THIS IS AN UNSTAFFED FACILITY. IF YOU ARE NOT COMFORTABLE EXERCISING ALONE OR WITHOUT ON-SITE SUPERVISION, DO NOT SIGN THIS AGREEMENT.
1. Acknowledgment of Unstaffed Facility
I understand that SANCTUM Fitness LLC is a 24/7, unstaffed fitness facility. There may be no employees present at any time. I am exercising at my own risk. In case of emergency, I am responsible for contacting 911 or emergency services. Surveillance cameras may be in use for security purposes.
2. Assumption of Risk
I understand that use of a fitness facility includes inherent risks, including but not limited to: serious injury, disability, or death; equipment malfunction or misuse; slips, falls, or other accidents; overexertion or medical complications. I voluntarily assume all risks, known and unknown, associated with my use of the facility.
3. Medical Representation
I certify that I am physically able to participate in exercise activities. I have consulted a physician if necessary. I will stop exercise immediately if I feel pain, dizziness, or discomfort.
4. Waiver & Release of Liability
To the fullest extent permitted by law, I hereby release and discharge SANCTUM Fitness LLC, its owner(s), employees, contractors, and affiliates from any and all liability, claims, or causes of action arising out of injury, illness, death, property damage or theft, use or misuse of equipment, or negligence.
5. Equipment Use Agreement
I agree to use equipment only as intended, not attempt lifts or exercises beyond my ability, use safety mechanisms where applicable, and wipe down equipment after use.
6. Access & Security
My access (biometric, QR code, or app-based entry) is non-transferable. Sharing access with others will result in immediate termination. Unauthorized entry or allowing non-members inside is strictly prohibited.
7. No Training or Supervision
No personal training or supervision is provided unless explicitly arranged. I am solely responsible for my workout choices and safety.
8. Rules & Conduct
I agree to respect the facility, equipment, and other members; re-rack weights and maintain cleanliness; not engage in unsafe or disruptive behavior; and follow all posted rules and policies.
9. Damages
I agree to be financially responsible for any damage I cause to equipment or the facility due to misuse or negligence.
10. Recurring Payment Authorization
I understand and agree that my membership fee is $159.00 per month, plus any applicable taxes or fees disclosed at enrollment. By signing below and providing a payment method, I authorize SANCTUM Fitness LLC to charge my designated card, bank account, or other approved payment method on a recurring monthly basis until my membership is canceled in accordance with SANCTUM's membership terms. I understand that it is my responsibility to keep my payment information current and valid. If a payment is declined or returned, SANCTUM Fitness LLC may suspend or revoke access until the balance is paid and the payment method is updated. I understand that membership fees are non-refundable except as required by law or as otherwise expressly stated in writing by SANCTUM Fitness LLC.
11. Surveillance & Privacy
I understand that video surveillance may be used for safety and security, and footage may be used in the event of incidents, investigations, or rule violations.
12. Termination of Membership
SANCTUM Fitness LLC reserves the right to revoke membership at any time for violations of this agreement, and to deny access for safety, security, or policy reasons.
13. Sex Offender Policy
Membership in SANCTUM is strictly prohibited for any individual who is a registered sex offender in any state or jurisdiction. By signing this agreement, you certify that you are not a registered sex offender. Discovery of false attestation will result in immediate, permanent membership termination, forfeiture of all fees paid, and may be reported to local law enforcement. SANCTUM reserves the right to verify registries at any time.
14. Indemnification
I agree to indemnify and hold harmless SANCTUM Fitness LLC from any claims brought by third parties as a result of my actions.
15. Governing Law
This agreement shall be governed by the laws of the State of Minnesota.
16. Severability
If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force.
