SANCTUM

In consideration of the minor named below being permitted to enter and use the SANCTUM Fitness facility, the undersigned parent or legal guardian agrees as follows:

1. Parental Authority & Capacity. I certify that I am the parent or court-appointed legal guardian of the minor named below, that the minor is under eighteen (18) years of age, and that I have full legal authority to sign this Agreement on the minor's behalf. I am at least eighteen (18) years of age and am signing voluntarily.

2. Acknowledgment of Unstaffed Facility. I understand that SANCTUM Fitness LLC is a 24/7, unstaffed fitness facility. There may be no employees or personnel present at any time. No staff member will supervise, monitor, instruct, or assist my child. In case of emergency — including medical emergencies, fire, or criminal activity — no one is available to render first aid, CPR, or medical assistance, and the responsible adult present is solely responsible for contacting 911. I knowingly accept all risks associated with allowing my child into an unsupervised exercise environment, including delayed emergency response.

3. Mandatory Adult Supervision. I agree that my child may not be present at the facility at any time unless accompanied and directly supervised by me or another responsible adult over the age of eighteen (18) whom I have designated below. The supervising adult must remain with the minor at all times, must not leave the minor alone in the facility for any period, and must not permit the minor to use the minor's own access credentials. I understand that leaving a minor unattended in the facility is a material violation of this Agreement and may result in immediate and permanent termination of access without refund.

4. Assumption of Risk on Behalf of the Minor. I understand that use of a fitness facility — including free weights, machines, cables, and cardiovascular equipment — involves inherent and significant risks, and that these risks may be heightened for a developing minor. These include serious bodily injury, broken bones, growth-plate and skeletal injury, joint and ligament damage, cardiovascular events, heat exhaustion, disability, paralysis, and death. Additional risks include equipment malfunction, slips and falls, overexertion, improper technique, and the actions of other people present. On behalf of myself and my child, I voluntarily and expressly assume all such risks — known and unknown.

5. Medical Representation. I certify that my child is physically able and sufficiently healthy to participate in exercise activities without undue risk. I have either obtained medical clearance from a physician or made a personal, informed decision that such clearance is unnecessary, and I assume the risk of forgoing it. I have disclosed below any medical condition, allergy, injury, or medication relevant to my child's participation, and I authorize emergency medical treatment for my child if I cannot be reached.

6. Waiver, Release & Indemnification. To the fullest extent permitted by law, I, on behalf of myself, my child, and our respective heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue SANCTUM Fitness LLC, its owner(s), managers, employees, contractors, agents, and affiliates from any and all liability, claims, demands, damages, and causes of action arising out of or related to my child's presence on the premises, my child's use of the facility and equipment, any injury, illness, or death to my child, any loss of or damage to personal property, and any acts of passive or active negligence by the released parties. I further agree to indemnify, defend, and hold harmless the released parties from any claim brought by or on behalf of my child, including claims brought after my child reaches the age of majority, and from any attorneys' fees or costs incurred in defending such a claim. This release is intended to be as broad as permitted under the laws of the State of Minnesota.

7. Responsibility for Conduct & Property. I accept full financial and legal responsibility for the conduct of my child while on the premises, including any damage my child causes to equipment, fixtures, or the property of others. My child agrees to use equipment only in accordance with its intended purpose, to use available safety mechanisms, to wipe down equipment after use, to re-rack weights, to wear closed-toe athletic footwear and appropriate attire, and to conduct themselves respectfully. Disruptive, reckless, or unsafe behavior may result in immediate removal.

8. No Training or Supervision Provided. I acknowledge that no personal training, instruction, coaching, supervision, or spotting is provided by SANCTUM Fitness LLC unless separately arranged in writing. I am solely responsible for my child's exercise selection, form, safety precautions, and conduct, and I assume full responsibility for any injury that may result.

9. Privacy, Filming & Photography. SANCTUM Fitness LLC is a private facility. Filming, photography, or recording of any kind that captures other members, guests, or any identifiable person is strictly prohibited without that individual's express prior consent. I agree that my child and the supervising adult will respect the privacy and training experience of all other members and guests.

10. Lost or Stolen Property. SANCTUM Fitness LLC is not responsible for any personal property that is lost, stolen, damaged, or misplaced on the premises. I assume all risk of loss for property my child or I bring onto the premises.

11. Revocation of Access. I understand that SANCTUM Fitness LLC may, at its sole discretion and at any time, revoke or decline access for any minor, with or without cause, and that this Agreement does not create any right of continued access.

12. Governing Law & Venue. This Agreement shall be governed by the laws of the State of Minnesota. I consent to the exclusive jurisdiction and venue of the state and federal courts located in Hennepin County, Minnesota.

13. Entire Agreement & Electronic Signature. I acknowledge that I have read this entire Agreement, that I fully understand its contents and legal effect, and that I am signing it voluntarily on behalf of my child and myself. I understand that by signing I am giving up substantial legal rights, including the right to sue SANCTUM Fitness LLC. My typed name constitutes my legally binding electronic signature, and I certify that the information I have provided is true and correct.
